EmmaVPN Terms and Conditions

Welcome to EmmaVPN. These Terms and Conditions (“Terms”) govern your use of our website (www.emmavpn.com), applications, and VPN services (collectively, the “Service”). By accessing or using EmmaVPN, you agree to be bound by these Terms.

If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use EmmaVPN. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

2. Description of Service

EmmaVPN provides a virtual private network (VPN) service designed to enhance user privacy and security by encrypting internet traffic and masking IP addresses.

While we aim to provide a secure and reliable service, EmmaVPN is provided on an “as is” and “as available” basis without guarantees of uptime, speed, or availability.

3. Account Registration and Security

To access certain features, you may be required to create an account. The following applies:

Display Name (required) – visible to us
Username (required) – used internally and not accessible or visible to us
Password (required) – securely encrypted and not visible to us
PIN (required) – used for authentication on new devices and not visible to us
Email Address (optional) – used only for recovery, communication, or support if provided
Recovery Phrase (provided at account creation) – required for password recovery and not stored by us

Account Access and Authentication

To log in on a new device, you must provide:
- Username
- Password
- Your account PIN
If you log out of your current device, you will be required to re-enter:
- Username
- Password
- PIN
Without the correct PIN, access to your account on new or logged-out devices will not be possible

Important Account Security Notice:

Your password can only be recovered using your recovery phrase
EmmaVPN support cannot reset or recover your password
We do not store recovery phrases anywhere
We do not have access to your username, password, or PIN
If you lose your recovery phrase or PIN, you may permanently lose access to your account

You are solely responsible for:

Safely storing your recovery phrase
Remembering your PIN
Maintaining the confidentiality of your credentials
All activity conducted under your account

EmmaVPN is not responsible for account loss due to failure to safeguard your credentials.

4. Acceptable Use and Prohibited Activities

You agree to use EmmaVPN in compliance with all applicable laws and regulations. You must not use the Service for any unlawful, harmful, or abusive purposes.

Prohibited activities include, but are not limited to:

a. Illegal Activities

Engaging in any activity that violates laws or regulations
Fraud, identity theft, or financial crimes
Hacking or unauthorized system access
Distribution of malware or harmful software

b. Impersonation and Misrepresentation

Impersonating another individual, organization, or entity
Misrepresenting your identity or affiliation

c. Intellectual Property Violations

Distributing or accessing copyrighted material without authorization
Violating intellectual property rights

d. Network Abuse

Sending spam or phishing communications
Launching denial-of-service attacks
Interfering with networks or systems

e. Harmful Conduct

Harassment, threats, or abusive behavior
Distribution of harmful or illegal content

We reserve the right to suspend or terminate accounts involved in such activities.

5. Fair Usage Policy

EmmaVPN enforces a comprehensive Fair Usage Policy to ensure that all users receive consistent, reliable, and high-quality service. This policy is designed to prevent abuse, protect infrastructure, and maintain fair access across the network.

a. Purpose of the Policy

The Fair Usage Policy exists to:

Ensure equal access to bandwidth and resources for all users
Maintain optimal network performance and stability
Prevent misuse that could degrade service quality
Protect infrastructure from excessive strain or exploitation

EmmaVPN is intended for reasonable personal use, not for large-scale or abusive operations.

b. Definition of Abuse and Excessive Use

Abuse or exploitation of the Service includes, but is not limited to:

Excessive Resource Consumption

Continuous high-bandwidth usage that negatively impacts other users
Running long-duration, non-stop connections designed to maximize throughput
Using the Service in a way that creates disproportionate load on servers

Automated and Non-Personal Use

Operating bots, scripts, or automated systems generating traffic
Mass data scraping, crawling, or automated requests
Traffic generation intended to manipulate systems or services

Commercial or Unauthorized Use

Reselling, redistributing, or sharing your account or access
Using EmmaVPN as infrastructure for hosting services or business operations
Running servers, nodes, or relay systems through the VPN

Circumvention and Exploitation

Attempting to bypass system limits, safeguards, or intended usage
Exploiting vulnerabilities in the Service or infrastructure
Using multiple accounts or methods to evade restrictions

c. Network Protection Measures

To protect all users and maintain service integrity, EmmaVPN may:

Monitor aggregate system performance and usage patterns (without logging individual activity or content)
Temporarily limit bandwidth or connections in cases of abnormal usage
Restrict access to certain servers or features
Automatically flag or restrict accounts showing signs of abuse

These measures are strictly technical and are not used to track user activity.

d. Enforcement Actions

If your usage is determined to violate this Fair Usage Policy, EmmaVPN may take one or more of the following actions:

Issue warnings (at our discretion)
Apply temporary or permanent usage limitations
Suspend or terminate your account without prior notice
Restrict access to specific features or servers

Important:

Accounts terminated due to abuse or exploitation are not eligible for refunds
Enforcement decisions are made to protect the broader user base and infrastructure

e. Good Faith Use

Normal usage—including streaming, browsing, gaming, and general privacy protection—will not be affected by this policy.

You will not be penalized for typical personal use of the Service.

f. No Impact on Privacy

Enforcement of the Fair Usage Policy does not compromise your privacy:

We do not inspect or log your browsing activity
We do not monitor the content of your traffic
Any analysis is limited to non-identifiable system-level metrics

g. Policy Updates

We may update or refine this Fair Usage Policy to adapt to new threats, technologies, or usage patterns. Continued use of the Service constitutes acceptance of any updates.

6. No-Logs Policy

EmmaVPN operates under a strict and fundamental No-Logs Policy, which is a core part of our service design and privacy commitment.

a. What “No Logs” Means

We do not collect, monitor, store, or retain any data related to your VPN activity, including:

Websites you visit
Applications you use
Content you access, download, or transmit
DNS queries or browsing requests
Traffic data or communication content

Your online activity while connected to EmmaVPN is not recorded, tracked, or stored in any form.

b. Connection and Network Data

We do not log or retain connection-related metadata, including:

Your real IP address
Assigned VPN IP addresses
Connection timestamps (start or end times)
Session duration
Bandwidth usage tied to an individual user
Device identifiers linked to activity

This means there is no historical record of your VPN sessions.

c. Technical Design

Our systems are designed to:

Avoid generating identifiable activity logs
Operate without persistent storage of user activity
Minimize data collection at every level of the infrastructure

Because of this design, even if requested, we cannot provide activity data—it simply does not exist.

d. What Limited Data Exists

The only data associated with your account is:

Display name (required)
Email address (optional)

Payment data is handled by third-party providers and is not tied to your VPN usage.

e. Legal and Compliance Position

Due to our no-logs architecture:

We cannot monitor user activity
We cannot associate VPN usage with a specific individual
We cannot provide browsing or connection data to third parties

However, you remain responsible for your actions while using the Service.

f. Limitations of No-Logs

While we provide strong privacy protections:

No-logs does not make illegal activity permissible
External factors (such as websites, services, or devices you use) may still collect data independently
Your overall privacy also depends on how you use the internet outside of the VPN

g. Commitment to Privacy

The no-logs policy is not just a statement—it is a technical and operational principle built into EmmaVPN. We intentionally limit data collection so that your activity remains private by design, not by policy alone.

7. Payments and Subscriptions

EmmaVPN is a paid subscription-based service, and access to the Service requires an active subscription.

a. Subscription Model

All EmmaVPN plans provide full access to all available features
There are no tiered feature restrictions unless explicitly stated
Subscription duration and pricing are displayed on our website at the time of purchase

b. Billing and Payment Processing

Payments are processed securely through third-party payment providers
We do not store full payment details such as card numbers or security codes
Payment providers may collect necessary billing information, including:
- Full name
- Billing address
- Country and tax details
- Currency used for the transaction

By purchasing a subscription, you agree to the terms of the payment provider used.

c. Automatic Renewal

Subscriptions may automatically renew at the end of each billing cycle unless canceled
Renewal charges will be applied using the original payment method
It is your responsibility to cancel your subscription before the renewal date if you do not wish to continue

d. Pricing and Currency

Prices may vary depending on your location, currency, or applicable taxes
Currency is determined at the time of purchase

e. Refund Policy

Refunds, if offered, are subject to our refund policy and applicable laws
No refunds will be issued in cases including (but not limited to):
- Violation of Terms

- Use of the Duress PIN (account deletion)
Partial usage of the subscription period does not guarantee eligibility for a refund

f. Subscription Responsibility

You are responsible for:

Monitoring billing cycles and renewal dates
Managing or canceling your subscription through available tools

Failure to cancel before renewal may result in continued billing.

g. Service Access

Access to EmmaVPN is granted only while your subscription is active
Expired or unpaid subscriptions may result in:
- Loss of access to the Service
- Suspension of account functionality

8. Duress PIN Feature

EmmaVPN offers a Duress PIN for emergency use:

Activation will permanently delete your account
All data and access will be erased
All subscriptions will be lost and cannot be recovered or refunded

Use only in genuine emergency situations.

9. Service Availability

EmmaVPN strives to provide reliable and continuous service; however, availability is not guaranteed.

You acknowledge that:

The Service may be temporarily unavailable due to maintenance, updates, or system upgrades
Interruptions may occur due to factors outside our control, including:
- Internet service provider issues
- Data center outages
- Government actions or restrictions
- Cyberattacks or malicious activity
Performance (including speed and latency) may vary depending on:
- Your location
- Network conditions
- Device capabilities

We reserve the right to:

Modify, suspend, or discontinue any part of the Service at any time
Limit access to certain servers or features
Perform maintenance without prior notice

We are not responsible for any inconvenience, loss, or damage caused by service interruptions or performance issues.

10. Limitation of Liability

11. Indemnification

You agree to fully indemnify, defend, and hold harmless EmmaVPN, its owners, operators, employees, affiliates, and partners from and against any and all claims, demands, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

Any use or misuse of EmmaVPN by you or anyone using your account
Activities conducted through your account, whether authorized or unauthorized

b. Violation of These Terms

Failure to comply with the Acceptable Use Policy or Fair Usage Policy

c. Illegal or Unlawful Conduct

Any violation of applicable laws or regulations
Use of the Service for unlawful purposes, including fraud, hacking, or distribution of illegal content

d. Infringement of Third-Party Rights

Violation of intellectual property rights (e.g., copyright, trademarks)
Violation of privacy, data protection, or other legal rights of third parties

e. Disputes and Claims

This includes, but is not limited to:

Claims brought by third parties, organizations, or authorities
Legal actions, investigations, or enforcement proceedings
Financial damages or penalties resulting from your actions

f. Scope of Responsibility

Your indemnification obligation means:

You are responsible for covering costs incurred by EmmaVPN as a result of your actions
This may include legal defense costs, settlements, fines, or damages
Your responsibility applies even if EmmaVPN was not directly at fault

g. Continuing Obligation

This indemnification obligation:

Applies during your use of the Service and continues after termination
Remains in effect even if your account is closed or deleted

h. No Limitation by Privacy

EmmaVPN’s no-logs policy does not limit your responsibility under this section. Even though we do not track your activity, you remain fully accountable for how you use the Service.

12. Privacy

Your privacy is a fundamental principle of EmmaVPN.

Key principles include:

We operate a strict no-logs policy (no tracking of browsing or connection activity)
We collect only minimal data necessary for account functionality and payments
We do not store:
- Browsing history
- IP logs
- Traffic content

Account Data:

We can only access your display name and optional email
Username, password, and PIN are not accessible to us

Security:

Recovery phrases are not stored and cannot be retrieved
We cannot reset passwords or recover accounts

Third Parties:

We are not responsible for how third parties process your data, though we use trusted providers

While we take strong measures to protect your data, no system is completely secure. By using the Service, you acknowledge and accept this risk.

13. Intellectual Property

All content, software, branding, design elements, and underlying technology associated with EmmaVPN are the exclusive property of EmmaVPN or its licensors and are protected by applicable intellectual property laws.

You agree that you will not:

Copy, reproduce, modify, distribute, or create derivative works from any part of the Service
Reverse engineer, decompile, or attempt to extract source code or underlying technology
Use EmmaVPN’s name, logo, branding, or design without prior written permission

User Responsibility:

You are solely responsible for ensuring that any content you access, transmit, or distribute through the Service complies with intellectual property laws
EmmaVPN does not permit or support the unauthorized distribution of copyrighted materials

Any violation of this section may result in immediate suspension or termination and potential legal action.

14. Termination

We reserve the right to suspend, restrict, or terminate your access to EmmaVPN at our sole discretion, with or without notice, under the following circumstances:

Abuse or exploitation of the Service under the Fair Usage Policy

Failure to comply with payment obligations

Effects of Termination:

Immediate loss of access to your account and all associated services
Deactivation or deletion of account data (where applicable)
Forfeiture of any active subscriptions or remaining service time
No entitlement to refunds unless required by law

Additional Notes:

Termination decisions are final and made to protect the Service, users, and infrastructure
We are not obligated to provide prior warning or explanation
You remain responsible for any actions taken prior to termination

You may also stop using the Service at any time; however, no refunds will be issued for unused subscription periods unless explicitly stated.

15. Changes to Terms

EmmaVPN reserves the right to update, modify, or revise these Terms and Conditions at any time to reflect changes in our services, legal requirements, business practices, or security needs.

Enforcement and Legal Responsibility

EmmaVPN may suspend or terminate accounts that violate these Terms

Critical Features and Consequences

Using the Duress PIN will permanently delete your account and all subscriptions, with no recovery or refund
Loss of your recovery phrase or credentials may result in permanent account loss

Agreement to Terms

By continuing to use EmmaVPN, you agree to all Terms and any future updates
If you do not agree, you must stop using the Service
